AppLand Sync Licence Terms

These terms apply when you ("Licensee", "you") buy a licence for a Track through AppLand Sync. AppLand Sync is operated by CAF, trading as AppLand, ("AppLand", "we"). Each licence is granted by the Track's creator ("Creator"). AppLand sells it as the Creator's agent and runs the platform.

1. WHAT YOU GET

1.1 When you pay, the Creator grants you a non-exclusive, non-transferable licence to synchronise the Track with your Project and to distribute that Project as your licence tier allows. 1.2 "Project" means the single production named at checkout, such as one podcast series, one video, one film or one campaign. 1.3 Unless your tier says otherwise, the licence is worldwide and lasts for the life of the Project. 1.4 You receive the audio file, a licence certificate and the Track's Provenance Certificate.

2. LICENCE TIERS

Creator (£29): Online and social video, podcasts, streams, personal and small-business projects, and paid social ads up to £1,000 media spend. One Project. Does not cover broadcast TV, cinema, or paid ads over £1,000 media spend. Pro (£149): Everything in Creator, plus broadcast TV, VOD, cinema, paid ads at any spend, and corporate and client work. One Project. Does not cover use outside the named Project. Enterprise (quoted): Custom scope, multiple Projects, extended terms and invoicing, as set out in your quote.

3. WHAT YOU MAY DO

3.1 Edit, loop, cut down, fade and mix the Track to fit your Project. 3.2 Keep using the Track in your Project after it is published, including in archives and re-uploads of the same Project. 3.3 Use the Track in trailers and promotion for the same Project.

4. WHAT YOU MAY NOT DO

4.1 Distribute, sell, stream or share the Track on its own, or as the main feature of a product, such as a music release, sample pack or ringtone. 4.2 Register the Track, or any Project containing it, with YouTube Content ID or any other fingerprinting service. 4.3 Use the Track to train, fine-tune or test any AI model. 4.4 Claim authorship of the Track, or use it in a trademark, logo or sound logo. 4.5 Use the Track in content that is unlawful, defamatory, hateful or sexually explicit, or in political campaign advertising, without our written consent. 4.6 Transfer or sub-licence your licence, except to contractors working on your Project.

5. AI-GENERATED MUSIC AND WHO IS RESPONSIBLE

5.1 Tracks on AppLand are created wholly or partly with AI tools. The law on copyright in AI-generated material differs between countries and is still developing. 5.2 The Creator is responsible for the Track. The Creator has warranted that they own the rights, that the Track is original, and that the tools they used allow commercial use. The Creator has also agreed to indemnify you against claims arising from a breach of those warranties, and you can enforce this directly against them. 5.3 AppLand reviews listings and runs the platform, but does not own the Tracks. AppLand gives no warranty or indemnity about a Track's legal status, other than the remedies in clause 6. The Provenance Certificate records the Creator's own disclosures; AppLand has not independently verified them.

6. IF THERE IS A PROBLEM WITH A TRACK

6.1 If we receive a credible claim about a Track you have licensed, we will tell you within 5 working days. 6.2 We will offer you a replacement Track of similar style at no cost or, if you prefer, a full refund of the licence fee. 6.3 We will only ask you to remove the Track from published content where we are legally required to, or where a claim makes continued use unlawful. 6.4 If you wish to pursue a claim against the Creator, we will give you their legal name, country and contact email. 6.5 See the Claims & Responsibility page for how to report a claim.

7. OUR LIABILITY

7.1 Our total liability to you for any claim about a licence is limited to the licence fee you paid. 7.2 We are not liable for indirect or consequential loss, such as lost profits, lost revenue or the cost of re-editing or re-publishing content. 7.3 Nothing in these terms limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by our negligence.
